Con decreto ministeriale n. 12110/2024 del 24 giugno 2024, l'esplosivo denominato «Indetshock/Shock Star Dual Delay», gia' classificato, con numero ONU 0360 1.1B o 0500 1.4S, nella III categoria di cui all'art. 82 del regio decreto 6 maggio 1940, n. 635 ed iscritto nell'allegato «A» al medesimo regio decreto con il decreto ministeriale n. 557/P.A.S.23424-XVJ/2/29/2008 CE (37) del 21 gennaio 2011, pubblicato nella Gazzetta Ufficiale - Serie generale - n. 41 del 19 febbraio 2011, e' fabbricato nei tempi di ritardo ed in conformita' alle indicazioni tecniche riportate nei supplementi dal n. 2 al n. 6 di integrazione al certificato BAM (Germania) n. 0589.EXP.4596/02 del 12 agosto 2003, emessi dal medesimo organismo notificato rispettivamente nelle date 7 aprile 2011, 13 settembre 2012, 31 marzo 2014, 17 ottobre 2016, 3 agosto 2017.
Allo stesso esplosivo, in accordo al supplemento n. 7 rilasciato dal citato organismo notificato in data 20 maggio 2022, e' assegnata la nuova denominazione «Shock*Star Dual Delay» in sostituzione alla precedente con i tempi di ritardo di seguito elencati:

L'esplosivo in argomento e' prodotto dalla Austin Detonator s.r.o. presso lo stabilimento sito in Vsetin - Repubblica Ceca, come riportato nel modulo D n. 2.5/1980/21 e n. 2.5/1981/21 del 27 giugno 2022, rilasciati dal BAM (Germania).
Infine, al detonatore in parola, quando imballato secondo le specifiche indicate nella decisione n. 73-06307-18, del 31 agosto 2018, rilasciato dal Banco di prova Ceco, e' assegnato il numero ONU 0361 1.4B.
In ordine al citato esplosivo il sig. Calogero Lo Piccolo, titolare in nome e per conto della societa' «Sei Epc Italia S.p.a.» delle autorizzazioni ex articoli 46 e 47 T.U.L.P.S. per lo stabilimento sito nel Comune di Tivoli (RM) - loc. La Botte, ha prodotto la documentazione sopra indicata.
Avverso tale provvedimento e', dunque, esperibile ricorso giurisdizionale al Tribunale amministrativo regionale ai sensi del decreto legislativo 2 luglio 2010, n. 104 o, in alternativa, ricorso straordinario al Presidente della Repubblica ai sensi del decreto del Presidente della Repubblica 24 novembre 1971, n. 1199, nel termine, rispettivamente, di sessanta e centoventi giorni dalla data della notificazione o comunicazione o dalla data in cui l'interessato ne abbia avuto piena cognizione.
